Amendment 59: does it shore up education or undermine TABOR?

Amendment 59 would allow the state government to retain surpluses of tax revenue in strong economic years and use these funds to supplement the state budget for education in lean years. Opponents contend that this would violate the TABOR Amendment, which capped tax-increases and dictated that any surpluses must be refunded to taxpayers. Supporters see this is as a way to provide a stable funding source for education and to ensure that Amendment 23's (2000) mandate to increase school funding to meet national averages is met.
